Definitions

HSE Training Solutions SAS hereinafter called “HSETS” and person who visits and/or uses the services of the web pages www.hsets.com or www.hsets.net hereinafter called “User”

Service Activation

We will set up the user account after the payment has been received and we or our payment partners have analyzed the request (s) to check it in case of fraud. All new requests are generally activated within 24 hours. If the User has not been activated within this time, please click the following link to contact our customer service department support@hsets.com.

Contents and Activities

All services rendered by HSETS may only be used for lawful purposes. This includes, but it is not limited to: Esto incluye, pero no limitado a: copyright material, material we consider threatening or obscene. The User undertakes to compensate and keep HSETS free from all resulting claim from the use of our services.

Malicious Code Distribution

The intentional software distribution that attempts to and/or causes damage, harassment or annoyance to people, data and/or computer systems are prohibited. Examples of these are computer virus, trojans and Internet worms. Such offense will result on the immediate termination of the offender’s User account.

Infringement

Copyright, Patents, Trade Mark Rights, trade secrets or intellectual property violation: The distribution and/or release of material protected by copyright of by the mentioned infringements will not be tolerated. The use of HSETS to transmit any material (via e-mail, files, or else) which violates copyright, trade marks, patents, rights of property marks of industrial secrets or others from a third party, including, but not limited to the unauthorized copy of copyright material, digitizing and distribution of magazines photographs, books, or any other copyright protected source and the unaothorized transmision of copyright protected software is prohibited.

Junk e-mail

We have a zero tolerance position against sending junk e-mail, sending a bulk e-mail treated as spam. Any User sending spam will have his account terminated without early notice.

Modification
HSETS reserves the right to request changes or to disable as needed any web site, account, database, or other component that does not comply with this policy, to it entire discertion. HSETS also reserves the right to perform any change in case of emergency to our discretion.

Bulk Email / Email scripts

They are prohibited in any HSETS server. The sending e-mail rate on all HSETS servers has a maximum of e-mails per hour per account, as well as this going back to the sender. If you require more than this, please send an e-mail to our customer service department.

Usenet Spam

HSETS has a zero tolerance policy for the use of its servers for sending commercial mesagges or advertisements, that violates the rules, regulations, FAQ or the letter of the newsgroup or mailing list. The commercial messages that are appropiate under the rules of a newsgroup or mailing list or that are requested by the receiver are allowed.

Payment Information

The User agrees to pay for the services received from HSETS, before the term on which such services are rendered. The User agrees that unless he notifies HSETS his desire to cancel any or all the services received, these services will be billed recurrently

Data Losses and Backups

The use of HSETS web service is under your own risk. HSETS is not responsible for one and all files and the data residing on your account on our servers. HSETS does not keep safety backups of web sites or e-mail customers. HSETS can’t guarantee that the content of a web site will never be deleted or damaged, or that a safety backup of a web site will always be available. The User agrees to undertake full and sole responsibilty for one and all files and the data transferred to our servers and to keep all the propper safety backups of one and all files and the data stored on any HSETS server to which he has an account.

Completion of Data and Customer Privacy

For the privacy of the User, all files and data from cancelled accounts are written off immediately eliminated and purged from our servers. This includes any and all safety backup copies. Please, make sure to perform safety backups of all your files and data before cancelling your HSETS account.

Special Situations and Emergencies

We reserve the right to adopt all the proactive measures needed to keep the security, connectivity, performance and services of our network, the infrastructure and the customers, including but not limited to the actions that oblige us to disable the web sites, shut down our network, or the content review of the web sites to evaluate the reason of perceived behaviour. On rare ocasions, it could be necessary to eliminate completely a web site or an account as a result of a major failure, security breach or any other emergency. On these cases, we do our best effort to make a safety backup of an eliminated web site, but a complete restoration of the information cannot be guaranteed.

Account Security

The misuse of the account is the sole responsibility of the User. The User must take action to make sure that others do not have access to his account. Also, you cannot use your account to violate the security of another account or try to have unauthorized access to another network or server.

Your password grants access to your account. It is your responsibility to keep your password safe. We do not take responsibility of any misuse of your account due to the authorized or unauthorized distribution of your password.

Sharing your password and access account with non authorized Users id prohibited. You must take the necessary precautions to avoid others use your account since your are responsible for said use.

Trying to obtain the password from another User of the account is strictly prohibited and may result in the termination of the service. The User must adopt the necessary safety measures to avoid or reduce to the minnimum the unaothorized use of his account.

The Users who breach systems or security of the network may incurr in illegal or civil liability. HSETS will cooperate with the judicial authorities on the reaserch of alleged civil or criminal violations.

Cancellation and Refunds

HSETS has no refund policy and does nor offer a refund garantee of any kind. All sales are considered final. Any portion of our fees will not be able to be prorrated over the unused time.

The User may cancel his HSETS account at any desired time. If you joined PayPal, please enter your PayPal account and cancel your subscription contract. On the other hand, submit a service cancelation request to our customer service.

If you joined HSETS through the annual payment option and you cancel before the year is over. Your HSETS account will remain active until exact 365 days have passed since your last annual payment. After this term your account will be cancelled unless you renew your billing before the 365 days term have elapsed.

If you joined HSETS through the monthly payment option your account will be cancelled after 30 days since your last received payment by HSETS.

Cancellation for Non-Payment

Any account with outstanding billings older than 3 days may be terminated at any time without previous notice. HSETS will send at least two e-mails requesting the payment to the account holder before HSETS cancels any account for non-payment. HSETS will manage all files and data of the terminated accounts exactly as stated on the Cancellation and Refunds clause.

Refusal of Service

HSETS reserves the right to refuse rendering the service at its discretion.

Customer Knowledge and Responsibilities

The customer agrees that it is no HSETS responsibility to provide the knowledge needed to use the services on HSETS web page.

Auto Re-billing

For your convenience, your HSETS account will be automatically re-billed on a monthly, quarterly, or yearly basis (depending on the billing package selected at the time of purchase). If you wish your account is not auto re-billed, you must notify at least 2 days (48 hours) before the date the re-billing takes place. The failure to notify us your wish not to be re-billed, will be understood in a bill for your account and you agree to keep unscathed and pay HSETS of any and all claim of improper billing.

Indemnification
The User agrees he must defend, indemnify, keep and maintain HSETS protected from any demand, responsibility, losses, costs and claims, including any and all fees from licensed lawyers for and against HSETS, its agents, customers, officials and employees, that may arise or result from any rendered or performed or agreed service or any product sold from the User, his agents, employees or assignees. The User agrees to defend, indemnify and keep HSETS unscathed against the responsibilities resulting from: (1) any injury to a person or property caused by any product sold or distributed in relation to HSETS, (2) any material supplied by the customer or allegedly violate infringing the property rights of a third party,  (3) the copyright and/or patents violation and (4) any defective product sold to customers from a HSETS server.

 

If demands exist against HSETS. If HSETS is dued or is threatened to be sued in relation to the Service (s) provided, HSETS may pass it to the User who in all cases will indemnify and keep HSETS unscathed from the claims and expenses (including legal fees, judicial costs and profits). Under such circumstances, a complying bond from a good reputation bond compnay is accepted as a guarantee.  

Use of Terminal Changes

HSETS reserves its right to review, modify and update the previous (Terms of Service) at any time without previous notice to its entire discretion and may apply the changes of any and all updates and with retroactive character.
